North Carolina Disclosures
North Carolina requires a Residential Property Disclosure and Mineral Oil and Gas Disclosure to be completed by sellers and provided to buyers by the time the buyer makes an offer on the property. The following is a short explanation of the statute as it applies to most transactions. See NCGS 47E for complete details and exceptions.

COMPLETE: The seven pages of questions can be answered as Yes/No, No Representation, or Not Applicable if the property does not have the feature. You must complete all questions, answering to the best of your knowledge and agreeing to promptly correct any information found to be in error. You can be held liable for undisclosed hidden/latent defects. You agent is prohibited from filling this form out for you.

REFUSE: Sellers can willfully refuse to complete the disclosures. If the seller refuses to complete the disclosures and thereby does not provide the disclosures to the buyer before the contract signing, the buyer can exercise the right to cancel within 3 calendar days after signing and get all their money back. The right to cancel expires if not exercised in time.
